Chief Judge Timothy C. Evans, today, issued General Administrative Order 2025-10, emphasizing the applicability of the common law privilege against civil arrest for individuals attending court proceedings in Cook County.
The order, which takes effect Wednesday, Oct. 15., ensures that litigants and witnesses may appear in court without fear of being subjected to unrelated civil arrest during their attendance.
“The fair administration of justice requires that courts remain open and accessible, and that litigants and witnesses may appear without fear of civil arrest,” the order states. “The common law has long recognized this privilege to ensure individuals can fulfill legal duties without risking further legal jeopardy.”
Chief Judge Timothy C. Evans emphasized the importance of this order.
“Access to justice depends on every individual’s ability to appear in court without fear or obstruction. Our courthouses remain places where all people—regardless of their background or circumstance—should be able to safely and confidently participate in the judicial process,” Evans said Tuesday.
